2. KONU

İşbu sözleşmenin konusu, Alıcı'nın Satıcı’ya ait https://cometes.online internet sitesinden elektronik ortamda siparişini yaptığı aşağıda nitelikleri ve satış fiyatı belirtilen ürün/hizmetin satışı ve teslimi ile ilgili olarak 6502 Sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği hükümleri gereğince tarafların hak ve yükümlülüklerini belirlemektir.

4. GENEL HÜKÜMLER

4.1. Alıcı, https://cometes.online internet sitesinde sözleşme konusu ürünün temel nitelikleri, satış fiyatı, ödeme şekli, teslimat koşulları ve cayma hakkı konularında ön bilgilendirme formunu okuyup bilgi sahibi olduğunu, elektronik ortamda gerekli teyidi verdiğini kabul ve beyan eder.

4.2. Satıcı, sözleşme konusu ürün/hizmeti, eksiksiz, siparişte belirtilen niteliklere uygun şekilde, varsa garanti belgeleri, kullanım kılavuzları ile birlikte teslim etmeyi taahhüt eder.

4.3. Sipariş konusu ürün/hizmetin teslimatı için işbu sözleşmenin elektronik ortamda onaylanması ve bedelinin Satıcı’nın belirttiği ödeme yöntemiyle ödenmiş olması gereklidir.

4.4. Sipariş konusu ürünün teslimatı, Alıcı’nın belirttiği adrese ve belirtilen kişi/kuruluşa yapılır.

4.5. Teslim anında Alıcı’nın adresinde bulunmaması durumunda Satıcı, edimini tam ve eksiksiz olarak yerine getirmiş kabul edilir.

5. CAYMA HAKKI

5.1. Alıcı, ürün teslim tarihinden itibaren 14 (ondört) gün içinde herhangi bir gerekçe göstermeksizin cayma hakkına sahiptir.

5.2. Cayma hakkının kullanılması için bu süre içinde Satıcı’ya e-posta veya telefon yoluyla bildirimde bulunulması gereklidir.

5.3. Cayma hakkı kullanıldığında, ürün faturası ile birlikte ürün Satıcı’ya iade edilmelidir.

5.4. Cayma hakkı kapsamında iade edilen ürünün kargo bedeli Alıcı tarafından karşılanır.

6. CAYMA HAKKININ GEÇERLİ OLMADIĞI DURUMLAR

Aşağıdaki ürünlerde cayma hakkı kullanılamaz:

·       Alıcının özel istekleri veya kişisel ihtiyaçları doğrultusunda hazırlanan ürünler

·       İç giyim alt parçaları, mayo ve bikini altları, makyaj malzemeleri vb. hijyenik nedenlerle iadesi uygun olmayan ürünler

7. UYUŞMAZLIK DURUMUNDA

Bu sözleşmeden kaynaklanabilecek uyuşmazlıklarda, Ticaret Bakanlığı tarafından her yıl belirlenen parasal sınırlar dahilinde Alıcı’nın yerleşim yerindeki Tüketici Hakem Heyetleri ve Tüketici Mahkemeleri yetkilidir.

8. YÜRÜRLÜK

İşbu sözleşme, Alıcı tarafından elektronik ortamda onaylandığı tarihte yürürlüğe girer.

2. SUBJECT MATTER

The subject of this agreement is to set forth the rights and obligations of the parties in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts regarding the sale and delivery of the product/service, which the Buyer has ordered electronically through the website https://cometes.online, and whose qualifications and sales price are specified below.

4. GENERAL PROVISIONS

4.1. The Buyer acknowledges and declares that they have read and understood the preliminary information form on the website https://cometes.online regarding the essential characteristics, sales price, payment method, delivery conditions, and the right of withdrawal of the product subject to the contract, and confirmed this electronically.

4.2. The Seller undertakes to deliver the product/service subject to the contract completely, in accordance with the specifications specified in the order, and, if available, with warranty certificates and user manuals.

4.3. For the delivery of the product/service, this agreement must be approved electronically, and the price must be paid using the method specified by the Seller.

4.4. The product will be delivered to the address specified by the Buyer and to the individual or entity designated therein.

4.5. If the Buyer is not present at the address at the time of delivery, the Seller shall be deemed to have fulfilled their obligation in full.

5. RIGHT OF WITHDRAWAL

5.1. The Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of delivery, without providing any justification.

5.2. In order to exercise the right of withdrawal, the Buyer must notify the Seller by email or telephone within this period.

5.3. When exercising the right of withdrawal, the product must be returned to the Seller along with its invoice.

5.4. The return shipping cost under the right of withdrawal shall be borne by the Buyer.

6. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised for the following products:
• Products prepared in accordance with the Buyer’s special requests or personal needs
• Underwear bottoms, swimsuits and bikini bottoms, makeup products, and other items that are unsuitable for return due to hygiene reasons

7. DISPUTE RESOLUTION

In case of any disputes arising from this agreement, the Consumer Arbitration Committees and Consumer Courts at the Buyer's place of residence shall have jurisdiction within the monetary limits announced annually by the Ministry of Trade.

8. ENFORCEMENT

This agreement enters into force on the date it is electronically approved by the Buyer.
